Notice of this action would put those signatories and adherents not already named as parties to this action to a decision whether to apply to be joined as parties, with the expense that participation would cause, or to accept the consequences without an opportunity to affect the outcome, the “harsh choice” referred to in The Ahousat Indian Band v. the Attorney General of Canada et al., 2006 BCSC 646, at para. 29.
