The following excerpt is from Mailloux v Mindorff, 2016 ONSC 6003 (CanLII):

The term owner is not defined in the legislation. Notably, however, it is not defined as the registered owner. There are a number of authorities that stand for the proposition that the term includes the registered owner and the common law or actual owner. See, for example, Honan v. Doman Estate, 1974 CanLII 26 (SCC), [1975] 2 S.C.R. 866.
