2. The prosecution alleged the lewd acts in counts six and seven occurred between November 18, 2006, and August 9, 2013. Between January 2005 and September 2010, violations of section 288, subdivision (b)(1), were punishable by imprisonment for three, six, or eight years. (Stats. 2004, ch. 823, 7, pp. 6294-6295.) Since September 9, 2010, the punishment for violations of section 288, subdivision (b)(1), increased to five, eight, or 10 years in prison. (Stats. 2010, ch. 219, 7, pp. 1009-1010, eff. Sept. 9, 2010; People v. Soto (2011) 51 Cal.4th 229, 237, fn. 4.) The trial court applied the former version of section 288, subdivision (b)(1), as advocated by the prosecution's sentencing brief.
