What are the consequences of having a loaded firearm in a search and seizure?

A loaded firearm was found in appellant's waistband during a search of a home in Long Beach in 1998. After a jury trial, appellant was convicted of possession of a firearm by a felon (former 12021, subd. (a)(1); now 29800, subd. (a)(1)). He was sentenced to 25 years to life in prison as a third striker, with four additional years imposed for prison priors. ( 667, 667.5, 1170.12.)
