Wang relies on the decision of Mr. Justice Johnston in Balla v. Fitch Research Corporation, 2006 BCSC 275, where he found that a similar prayer for relief on an application could have permitted the defendant to go beyond the purely procedural aspects of its claim and to seek substantive relief (at para. 57). In the circumstances, Johnston J. found that the defendant had attorned to the jurisdiction.
