As to the third class, the implied warranties, the agreement contains the following provision, “The above-described engine is sold subject to the following conditions and warranties and no other.” Under Sawyer-Massey v. Ritchie, 1910 CanLII 27 (SCC), 43 Can. S.C.R. 614, this provision would cut out all implied warranties.
