Thus, on the assumption that the petitioner and respondents entered into this written agreement in a considered manner, as described in Reardon Smith v. Yngvar Transen-Tanger, supra, if the respondent expected the premises to be returned to him in better condition than they were in 1997, I would have expected the lease to have contained some provision to that effect.
