The law of causation in negligence is well-settled. The burden of proof is on the plaintiff to prove that the defendant’s negligence materially contributed to the harm suffered by the plaintiff; the negligence need not be the sole cause: Athey v. Leonati, 1996 CanLII 183 (SCC), [1996] 3 S.C.R. 458 at para. 15.
