Second, the issues sought to be resolved, e.g. whether the tenant renewed its lease and whether the tenant has a right of first refusal, are “inexorably intertwined” with other issues: Coast Foundation v. Currie, 2003 BCSC 1781 at para. 15. It will still be necessary to have a trial even if I could adjudicate the issues before me. There are related claims and counterclaims for breach of contract, misrepresentation, conspiracy and interference with contractual relations, as well as various estoppel claims by the parties.
