The case of the United States of America v. Dynar, 1997 CanLII 359 (SCC), [1997] 2 S.C.R. 462, set out the essential elements of a conspiracy. Those elements are: (a) An intention to agree; (b) Completion of the agreement; and (c) A common design to do something unlawful.
