The economic vulnerability to the long term effects of the death of a spouse caring for dependent children as noted in Law v. Canada, supra, at para. 103 is not age related. The distinction between the comparator groups here however seeks to exclude the subgroup of which the petitioner is a member from continuing benefit assistance although their age will not be significantly less than 40 and the legacy of disadvantage arising during single parenthood will not vary.
