The circumstances under which an order for consolidation is appropriate were considered in Discovery Enterprises v. Ebco Industries et al., 2001 BCSC 235. The application in Discovery was pursuant to former Rule 5(8) for an order directing that two actions, an oppression action and a derivative action, be tried together on the same day. In considering Rule 5(8), Pitfield J. stated as follows:
