In Stapley v. Hejslet, 2006 BCCA 34, 263 D.L.R. (4th) 19, leave to appeal refused [2006] S.C.C.A. No. 100, the court set out (at paras. 45-46) the factors that should be considered in making an award for general damages. The amount of an award for non-pecuniary damages should not depend only upon the seriousness of the injury but also upon its ability to ameliorate the condition of the victim considering his or her particular situation. Factors to be considered include impairment of family, marital and social relationships, impairment of physical abilities and loss of lifestyle.
