The defendants say that the last thing that significantly advanced the action was the filing and service of the last third party claim on March 19, 2012 and that no significant advancements occurred in the three years ending on or about March 19, 2015. Alternatively, they argue that if the forwarding of the expert report on August 2, 2012 was an advancement, that the three year window can be extended to August 2, 2015 based on Chan v.
