More recently, in Yan v. RLPS Limited Partnership, 2018 BCSC 672, the petitioner sought an order releasing a deposit paid under a contract to purchase her house. In concluding that enforcement, not construction of the contract, was being sought, Justice Schultes found the matter inappropriate for a petition proceeding and ordered the petitioner to file a notice of civil claim.
