When will a section of the Criminal Code be dismissed for want of prosecution?

British Columbia, Canada

The following excerpt is from Lebon Construction Ltd. v. Wiebe, 1995 CanLII 216 (BC CA):

46 The chambers judge considered the principles set out in Irving v. Irving, supra, and concluded that the section should be dismissed to want of prosecution. Taking into account the facts, including the nature of the action, I am of the view that the chambers judge properly dismissed the action.
