Although the court in Hryniak v. Mauldin recognized the summary judgment procedure to be a legitimate alternative to the conventional trial for the adjudication of civil disputes, the court reserved some concern about when the summary judgment procedure will not provide a fair and just process. At paragraph 50 of Hryniak v. Mauldin, Justice Karakatsanis said this:
