What is the appropriate living standard for the children of a separated parent?

New Brunswick, Canada

The following excerpt is from T.D.B. v. L.N.U., 2010 NBQB 408 (CanLII):

What is most important to bear in mind in determining the appropriate living standard of the children are the comments made by Bastarache J. in D.B.S. v. S.R.J. (supra) at paragraph 18 where, in quoting with approval the comments of Kelly J.A. in Paras v. Paras [1971] O.R. 130 (O.C.A.) he set out the core principles saying in part: …child support is the right of the child; the right to support survives the breakdown of a child's parents' marriage; child support should, as much as possible, provide children with the same standard of living they enjoyed when their parents were together; and finally, the specific amounts of child support owed will vary based upon the income of the payor parent.
