Similarly, in Laliberté v. Monteith, 2021 ONSC 14 at para 59, the Ontario Superior Court of Justice held that the applicant had established an exception to settlement privilege as the respondent had admitted to not disclosing a certain sale transaction during settlement negotiations, and accordingly “there is more than a bald allegation of misrepresentation or a failure to disclose”.
