The following excerpt is from Cox v. Cox, 1997 CanLII 16999 (ON SC):

[14] All of the criteria suggested in Newton v. Newton, supra, were present: different residences, steps were taken to financially separate their affairs and there were no further efforts to resume cohabitation in a meaningful way by either party after January 1996. Accordingly, this court finds that the date of separation of the parties with no reasonable prospect of reconciliation was the departure of the wife from the matrimonial home in January of 1996.
