A claim for rectification of an easement succeeded in McQuiggan v. Sharp, [1984] B.C.J. No. 1054 (S.C.). As the claim for rectification succeeded, the trial judge found it unnecessary to consider the alternative claim for modification of the agreement pursuant to the Property Law Act.
