The parties are in agreement that breach or violation of legislation alone is not a basis for a finding of liability in negligence. Conversely, mere compliance with legislation does not, in itself, preclude a finding of liability in negligence (Ryan v. Victoria (City), 1999 CanLII 706 (SCC), [1999] 1 S.C.R. 201, at para. 29).
