Nor is this an example of impermissible hostility by the court to defendant or defense counsel. (People v. Fudge (1994) 7 Cal.4th 1075, 1107.) Rather than saying defendant's decision was itself wrong, the court's comment was only that this type of choice tends to be a mistake. The court never expressed any hostility to defendant, and its other comments show a commendable effort to get the jury to focus on the evidence rather than defendant's choice of counsel.
