The foreign court must have jurisdiction over the action in accordance with the real and substantial connection test and the foreign judgments must be final and conclusive: Beals v. Saldanha, 2003 SCC 72 at para. 17. Hexing does not contest jurisdiction or that the judgments are final and conclusive.
