Gordon v. Goertz, 1996 CanLII 191 (SCC), [1996] 2 S.C.R. 27 has been the leading case on mobility issues in Canada for 25 years. The amendments to the Divorce Act have, in effect, codified certain aspects of that decision and modified others. The best interests of the child has always been the guiding factor to be considered, and now is the only factor to be considered in making a parenting order and determining if a relocation will be authorized.
